01 Who you are agreeing with

MangoBook is a product of Money Mango Marketing, a marketing and design studio in Toronto, Ontario, Canada. In this document “we”, “us” and “MangoBook” mean Money Mango Marketing, and “you” means the person or business that holds an account.

You can reach us at mango@moneymango.net. It is a real address read by a person, and it is the right place for anything in this document.

By creating an account or using MangoBook, you agree to these terms. If you are agreeing on behalf of a business, you confirm you are allowed to bind it.

02 What MangoBook is

MangoBook is booking software. It gives your business a hosted booking page at mangobook.net/your-name, and the same booking flow as an embed for a website you already have. One diary sits behind both.

We provide the software. We are not a party to any booking made through it. The agreement to turn up, to hold a table, to do the work and to be paid for it is between you and your customer. We do not take payment for bookings, do not hold money, and have no view on your cancellation or no-show terms — those are yours to set and to enforce.

MangoBook does not send email or SMS of any kind. It cannot send your customer a confirmation, a reminder or a cancellation. If your customer needs to be told something, you have to tell them.

03 Your account

You need an account to run a booking link. When you create one:

  • Give an email address that reaches you. It is the only way we have of contacting you.
  • Keep your password to yourself. Anything done with your credentials is treated as done by you.
  • You must be at least 16, or old enough to enter a contract where you live, whichever is higher.

There is no password reset today. MangoBook sends no email, so a password you cannot remember is an account you cannot get back into without writing to us. Write to us — we can help — but store the password somewhere sensible in the meantime.

You can give other people access to a booking link, scoped to the whole link or to named resources. You stay responsible for what they do with it, and for removing access when they leave.

04 Your customers' data

When somebody books with you — or writes to you through an enquiry form, if you have one — MangoBook stores their name and whatever contact details and answers your form asks for. That information is yours, not ours. We hold it on your behalf and we do not sell it, rent it, or use it to market anything to anybody.

In UK and EU terms, that makes you the controller of your customers' data and us a processor acting on your instructions. Practically, that means three things are your job and not ours:

  • Telling your customers what you collect and why — your own privacy notice, not this one.
  • Having a lawful reason to collect it, and not asking your booking form for more than you need.
  • Answering your customers when they ask to see their data or have it deleted. We will help you do it.

What we do with that data, how long we keep it, and how deletion is requested are all set out in the Privacy Policy, which forms part of these terms. If you need a signed data processing agreement, write to us.

05 What you may not do

The short version is: don't use a booking link to do harm. Specifically, do not use MangoBook to

  • take bookings for anything illegal where you or your customer are, or for anything you are not licensed or qualified to provide;
  • collect personal information under a false pretext, or impersonate another business — including by taking a slug that suggests you are somebody you are not;
  • send anyone unsolicited messages using details collected through a booking form;
  • attempt to reach data belonging to another account, defeat a rate limit, or probe the service for weaknesses without asking us first — security reports are welcome at the address in clause 1;
  • resell or white-label MangoBook as your own product, or run it as a booking service on behalf of unrelated third parties, without our written agreement;
  • put load on the service that is automated rather than human, or that is plainly out of proportion to the bookings you take.

Rate limits exist and are applied per venue and per client. We may raise or lower them for an individual account, and we may refuse traffic that looks like abuse.

06 Beta, availability and change

MangoBook is in beta. It is deployed, it is real, and venues take real bookings with it — but it is early software and you should read this clause as meaning what it says.

There is no uptime commitment and no service level agreement. We aim to be available, particularly at the hours a booking link matters most, and we do not promise it. Features may change or be removed. Nothing described anywhere on this site as not yet built is a commitment to build it.

We take backups and we monitor the service. Even so, keep your own record of anything you cannot afford to lose — a calendar feed subscription is the cheapest way to do that, and it is free on every plan.

07 Fees

MangoBook is free to use today, and no card is taken anywhere in the product. There is no checkout, no billing screen and no stored payment method. Nothing about signing up starts a trial or creates an obligation to pay.

The plans on the pricing page describe what we intend to charge when billing opens, and the limits they list are not currently enforced. Before any of that changes we will tell you here and at the address on your account, with reasonable notice and never retroactively. An account that stays on the free plan keeps a working booking link.

Once paid plans do exist, fees will be stated exclusive of any sales tax that applies to you, and charged in advance for the period they cover.

08 Your content and ours

Everything you put into MangoBook — your venue name, your copy, your branding, your floor plan, your bookings — stays yours. You give us permission to store it, process it and display it as far as running the service requires: showing your booking page to a customer, rendering your branding inside the embed, and putting your bookings in a calendar feed you asked for. That permission ends when the content is deleted.

MangoBook itself — the software, the name, the mango, the design of this site — stays ours. Embedding the widget on your own website is expressly allowed and is the point of it; copying the product is not.

On the free plan a small MangoBook badge appears on your booking page and inside the embed. Leaving it there is a condition of the free plan once plans are enforced. Removing it is currently free, and we will say so before that stops being true.

09 Ending it

You can stop using MangoBook whenever you like. Unpublishing a booking link from the console takes its public page down at once, and is never refused — it does not cancel a booking already in the diary, and you can publish again later. There is no way to delete a booking link or close an account from the console today; write to us and we will do it. What happens to the booking records behind it, and how long they survive, is in the Privacy Policy.

We may suspend or close an account that breaks clause 5, that puts the service or other venues at risk, or that we are required to act on by law. Except where something is seriously or repeatedly wrong, we will tell you what the problem is and give you a chance to fix it first.

If we ever discontinue MangoBook, we will give at least 60 days' notice to the address on your account and provide a way to export your bookings before it closes.

10 No warranty

MangoBook is provided as is. To the fullest extent the law allows, we make no warranties of any kind — express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the service will be uninterrupted, that it will be free of errors, or that it will meet your requirements. We do say one thing narrowly and mean it: an exclusive resource cannot hold two overlapping confirmed bookings, because a database constraint refuses them. That is a description of how the software works, not a guarantee against every way a diary can go wrong.

11 Liability

To the fullest extent the law allows, neither party is liable to the other for indirect, incidental, special or consequential loss, or for lost profits, lost revenue, lost bookings or lost goodwill, however caused.

Our total liability to you for any claim arising out of or relating to MangoBook is limited to the greater of the fees you paid us in the twelve months before the claim and one hundred Canadian dollars. While the service is free, that is the second of the two.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. If you are a consumer, you keep every statutory right you have where you live, and nothing here takes one away.

12 Governing law and changes

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and the courts of Ontario have jurisdiction. If you are a consumer in the UK or the EU, this does not deprive you of the protection of the mandatory laws of the country you live in.

We may change these terms. When we do, we will change the version and effective date in the block at the top of this page, and for any change that materially affects you — fees, liability, or what we may do with your data — we will give notice at the address on your account before it takes effect. Continuing to use MangoBook after that is acceptance.

If any clause here turns out to be unenforceable, the rest stands. Not enforcing something once does not waive it. These terms, together with the Privacy Policy, are the whole agreement between us about MangoBook.

Anything unclear?

Write to us before you rely on a reading of it. A plain answer by email is cheaper for both of us than a disagreement later.
